These terms of use (“terms”) govern your use of the Geek Strong website located at geekstrong.com (“site”), operated by Geek Strong LLC (“Geek Strong,” “we,” “us,” or “our”). By accessing or using this site, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree, please do not use the site. The section headings and numbered order used in these terms are for convenience and readability only and do not affect the interpretation, priority, or enforceability of any provision.

1. Use of the site

Geek Strong provides content, newsletters, tools, and resources focused on habits, wellness, and personal growth.

You may use the site for personal, non-commercial purposes unless we expressly state otherwise or offer paid products or services.

You agree not to:

  • Use the site for unlawful or harmful purposes

Geek Strong trademarks and branding

All content on this site is owned by Geek Strong LLC, unless otherwise stated, and is protected by copyright, trademark, and other applicable intellectual property laws. This includes, but is not limited to:

  • The Geek Strong name, word mark, and logos (including text-based and graphic logos)

  • patchOS and its six core habit system (Plan Ahead, Eat Well, Move Often, Stress Less, Love More, Sleep Deep), including their names, structure, original written expression, and associated visual identifiers, color systems, and logos

  • PatchBot, including character design, name, likeness, and personality

  • Patch Pick logos for each of the six core habits

  • Original characters appearing in Geek Strong Patches, illustrations, and related narrative works

  • Original written content, storytelling, illustrations, panel layouts, original visual compositions, graphics, and design elements

  • Newsletter and editorial content, including Patch Notes, Patch Previews, and Patch Picks, along with associated branding, visual systems, and logos

  • Site copy, illustrations, graphics, and design elements

Original content and creative works

Geek Strong, patchOS, PatchBot, and related names, logos, and visual identifiers are trademarks or service marks (whether registered or unregistered) of Geek Strong LLC. Nothing on this site grants you any license or right to use our intellectual property without prior written permission.

Geek Strong content—including text, illustrations, characters, stories, systems, and visual assets—may not be used, scraped, reproduced, or incorporated into artificial intelligence systems, machine learning models, or training datasets without prior written consent from Geek Strong. Any unauthorized use for machine learning, artificial intelligence training, data mining, or model development is expressly prohibited to the maximum extent permitted by law.

You may view, share links to, and reference Geek Strong content for personal, non-commercial purposes, provided you do not reproduce or modify it. Requests for permission to use Geek Strong’s intellectual property must be submitted in writing through our contact form and are subject to prior written approval by Geek Strong LLC.

Fictional content disclaimer

Some content on Geek Strong, including characters, names, stories, and scenarios, is fictional and created for educational and entertainment purposes. Any resemblance to actual persons, living or dead, or to real events is purely coincidental and not intended to represent any specific person or real-life situation.

3. Newsletter and communications

If you subscribe to our newsletter or email updates, you consent to receive communications from us. You may unsubscribe at any time using the link included in our emails. We do not sell or rent email addresses.

Content on Geek Strong is provided for informational and educational purposes only. While Geek Strong explores wellness, habits, and lifestyle topics through storytelling, science, and design, we do not provide medical advice, diagnosis, or treatment.

8. Limitation of liability

9. Arbitration and class action waiver

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms, your use of the site, or any content, products, or services provided by Geek Strong shall be resolved exclusively through final and binding arbitration, rather than in court. Arbitration shall be conducted on an individual basis only and not as a class, collective, consolidated, or representative action. You agree that you may bring claims against Geek Strong only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Small claims & equitable relief carve-outs

Either party may bring an individual claim in small claims court if the claim qualifies, provided it is brought in the appropriate jurisdiction. This arbitration provision also does not prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction for intellectual property misuse or unauthorized use of the site.

Arbitration procedure

The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. Unless otherwise required by law, the arbitration will take place in Gwinnett County, Georgia. Each party shall bear its own costs and attorneys’ fees, unless otherwise required by law or allocated by the arbitrator under applicable rules.

Opt-out right

You may opt out of this arbitration provision by providing written notice to Geek Strong via email or postal mail within 30 days of first using the site. The notice must include your name and a clear statement that you wish to opt out of arbitration.

Severability

If any portion of this arbitration or class action waiver provision is found to be unenforceable, the remaining portions shall remain in full force and effect.

Waiver of jury trial and class actions

YOU UNDERSTAND AND AGREE THAT BY ACCEPTING THESE TERMS, YOU ARE WAIVING YOUR RIGHT TO A TRIAL BY JURY AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

10. Governing law and venue

These terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-laws principles.

Any legal action or proceeding arising out of or relating to these terms or your use of the site must be brought exclusively in the state or federal courts located in Gwinnett County, Georgia, and you consent to the personal jurisdiction and venue of such courts.

11. Changes to these terms

We may update these terms from time to time. The “last updated” date at the top indicates when changes take effect. Continued use of the site after changes are posted constitutes acceptance of the updated terms to the extent permitted by law.
